FINES & ENFORCEMENT

To preserve the residential character of the Homesteads at The Harvest community, our Homeowners Association (HHA) has implemented a Fines & Enforcement Policy. This policy outlines the procedures for addressing violations of our Governing Documents, including how fines are assessed and enforced.

Compliance Process

  • Original Warning:

    • When a violation is identified, the Responsible Party (homeowner, tenant, or occupant) will receive a warning letter detailing the violation and the applicable section of the Governing Documents.

    • The homeowner typically has 30 days to correct the violation unless it requires immediate attention for health, safety, or welfare reasons.

    • If immediate action is needed, the Board may shorten the cure period or take direct action to remedy the issue, with costs charged to the homeowner.

  • Second and Continuing Violations:

    • If the violation is not corrected within the given timeframe, a second notice is sent by certified mail.

    • The notice will describe the violation, potential fines, and a new deadline for correction.

    • If still unresolved, a third notice will be sent, potentially resulting in additional fines and referral to legal counsel for further action.

  • Fines:

    • Fines are assessed for continuing violations and escalate with each subsequent notice:

    • First Fine: $100 after 30 days from the original warning.

    • Second Fine: $250 if the violation persists for another 30 days.

    • Third Fine: $500 if the violation continues for an additional 30 days.

    • Single occurrence violations (e.g., parking violations, pets running loose) have a separate fine structure, starting at $25 for a second occurrence within 12 months and increasing to $500 for repeated offenses.

Hearings to Dispute Violations:

  • Homeowners have 10 days from the date of the first notice to contest a violation or fine by requesting a hearing with the Board.

  • If no request is made within this period, the fine is considered final.

Fines as Liens:

  • Unpaid fines become a lien against the unit and may accrue interest at 12% per year if not paid within 30 days.

  • The cost of collecting fines, including legal fees, will be assessed against the homeowner.

Board Discretion:

  • The Board reserves the right to waive fines for good cause, but this does not set a precedent for future enforcement.

Examples of Violations

  • Single Occurrence Violations: Parking violations, pets running loose, failure to clean up after pets, and trash around the property.

  • Ongoing Violations: Unauthorized exterior changes, poor landscape maintenance, and failure to maintain property structures like driveways and fences.
